Patent Office Rules and form changes – October 2016

The Intellectual Patent Office is amending a selection of their patents forms following changes to the Patents Rules 2007 that come into force on 1 October 2016. The rule changes are being made to increase legal certainty, make procedures more flexible, and reduce administrative burdens for patent applicants and owners, following a consultation by the government process that was conducted earlier this year.

Patents Form PF20 will be revised to reflect that from 1 october, the form may also be used to update a name or address held by the Office following a change in circumstances such as a house move or change of name. Tick boxes will be added so the applicant can inform the Office whether they are requesting an update following a change in circumstances or a correction of an error. Patents Form PF14 will be revised to make it clearer to applicants what their accompanying evidence needs to contain. From 1 October 2016 it will no longer be necessary to provide duplicate copies of Patents Form PF51 and the notes o the form will be amended accordingly.

It will also no longer be necessary to file an international patent application in triplicate, when using the IPO as a receiving office under the Patent Cooperation Treaty (PCT).

The amended Patents forms are:-

  • PF14 – Request to reinstate a patent application (Patents Act 1977 (Rule 32))
  • PF20 – Request to correct a name or address (Patents Act 1977 (Rule 49))
  • PF51 - Appointment or change of agent (Patents Act 1977 (Rule 101))

New versions of these Patents forms will be made available in FormEvo in time for use from 1 October 2016.
